Can known 'non-legal target' be targeted?

Hello!
This is referring to this (http://wyrd-games.net/forum/showthread.php?t=19379) thread particularly, but I thought it could be applied more generally: if a model is known to be a non-legal target (new term p14) because for example you know it to be out of melee range (since you can pre-measure melee ranges at any time), can that non-legal target still be targeted? (for example through Shadowy Form)

In answer to the broader question: yes, a non-legal target can be declared as a target but the effect or Action would fizzle (see the thread).
